Can I seal or expunge a new arrest record after vacating a previous order to seal or expunge?
Even if you still qualify to have a criminal history record sealed or expunged, you will no longer qualify after having vacating a previous order to seal or expunge a record. This is explained in Florida Statutes, sections 943.0585(2)(f) and 943.059(2)(e). These sections of the Florida Statutes explain that an applicant cannot seal or expunge a criminal history record if they have previously sealed or expunged a criminal history record. Vacating an order does not remove or waive this requirement.
