What charges may not be sealed?
The application package provided by the Florida Department of Law Enforcement (FDLE) as well as our qualification form contain a list of all the different charges that do not qualify to be sealed, even if adjudication is withheld. The entire list can be seen in Florida Statutes, section 943.059. These same charges are also listed in Florida Statutes, section 943.0585 because they also can't be expunged. Additionally, if a person has ever been found guilty of any criminal charge in any jurisdiction, whether Florida or another state, and whether a felony or a misdemeanor, they don't qualify to seal or expunge any charges, whether they are related or not.
