What do I do with my Certificate of Eligibility?
If the Florida Department of Law Enforcement (FDLE) sends you a Certificate of Eligibility, saying you qualify to have your criminal history record sealed or expunged, there are several scenarios that can occur. First, if you choose either the Expeal package or the Attorney package, we will obtain your Certificate of Eligibility and handle it for you. However, if you order the Forms or do it on your own, the you need to file a petition to seal or expunge your criminal record with the court that handled your case. You have to include the original Certificate of Eligibility and an affidavit in support of your petition to seal or expunge. Remember - just getting a Certificate of Eligibility from the Florida Department of Law Enforcement (FDLE) does not mean your criminal history record is actually sealed or expunged. Rather, the final decision to seal or expunge your criminal history record is placed in the hands of the court by Florida state law.
