Thanks for using Expeal. These terms of service ("Terms") cover your use and access to the products, services, software, platform and websites (collectively, "Services") provided by Expeal, Inc. and any of our affiliates (collectively, "Expeal"). By using our Services, you agree to be bound by these Terms as well as our Privacy Policy. If you are using our Services as the employee or agent of an organization, you are agreeing to these Terms on behalf of that organization. Please note that the statements set forth under the headings "In simpler words" are provided as a courtesy solely for your convenience and are not legally binding or otherwise intended to modify these Terms in any way.

You must be the legal age of majority in your state of residence or otherwise able to form a binding contract with Expeal in order to use the Services. In no event is use of the Services permitted by those under the age of 13.

1. Free and Paid Versions

Free Versions

Registered users who complete a document interview will receive instructions on how to access their free criminal background check request and official forms ("Free Version"), regardless of whether that user upgrades to a paid version of the Services (individually, "Paid Version", collectively, "Free Versions").

Paid Versions

Expeal makes available several Paid Versions to customers who provide a valid payment instrument, such as a credit card or other payment method. If you choose to obtain a Paid Version, you will automatically be charged for the amount of the Paid Version you have chosen and you authorize Expeal to charge your payment method the fee, as applicable. If you wish to upgrade your Paid Version to a higher Paid Version, you will be charged the difference between your current Paid Version and the new Paid Version you are upgrading to. Please visit our pricing page for additional details on our Paid Versions.

To enable you to conveniently purchase additional products and services, Expeal will store and update (e.g., upon expiration) your payment method on file. If we are unable to charge your designated payment method for any reason, we reserve the right to automatically downgrade your paid plan to a lower-priced plan or to suspend your paid membership until your designated payment method can be charged agin. Please note that it is your responsibility to maintain current credit card information on file with Expeal.

2. Refund Policy

We want to make sure you are 100% satisfied with our Services. If you are less than satisfied or believe there has been an error in biling, please contact our customer service team by email at support [at] expeal.com or by telephone at (844) 839-7325 immediately so that we can help you resolve the issue, provide a refund, or offer credit that can be used for future Services.

When contacting us, please include any details relating to the Services you have purchased so that we can ensure you are completely satisfied with your experience with Expeal. All refund requests must be made within 30 days of purchase. If you wish to cancel an Expeal Paid Version, you may apply to receive a prorated refund for the remaining costs and labor which has not been used, minus a fee to cover the closing of your case. In order to apply for a refund relating to an Expeal Paid Version, please email refundrequest [at] expeal.com or call us at (844) 839-7325.

We do not offer refunds on payments we have collected for Forms packages or we have already paid to third parties in relation to your order. We also cannot refund any money paid by you directly to third parties, such as payments made by you for fingerprints, certified documents, or otherwise.

3. Membership Downgrade

Alternativeyly, you may call our customer service team at (844) 839-7325 during our regular business hours (9:00 am to 9:00 pm, Monday through Friday, Eastern Time).

Please note that if you choose to downgrade your Paid Version, Expeal reserves the right to collect fees from you to cover fees charged to Expeal or its agent on behalf of your order. Please note that downgrading does not affect your ability to access the documents you created on Expeal's website.

There is no other form of downgrade available. Please see section 2. Refund Policy for any other scenario.

Your use of the Services does not create an attorney-client relationship between you and Expeal, or between you and any Expeal employee or representative. Unless you are otherwise represented by an attorney, including a Participating Attorney, you represent yourself in any legal matter you undertake through our Services.

Expeal is not a "Lawyer Referral Service". The directory of lawyers published on our website is provided to the public free of charge and is for informational purposes only. Expeal does not endorse or recommend any attorney nor does it make any warranty as to the qualifications or competency of any attorney.

5. Interactions with Attorneys on Expeal

When you use our Services, you will have the opportunity to initiate contact with an independent attorney (a "Participating Attorney"). Participating Attorneys are neither employees nor agents of Expeal. Participating Attorneys are third-party independent contractors who carry their own malpractice insurance and have agreed to provide online answers, limited consultations, or other basic legal services to Expeal users. Communicating with a Participating Attorney through Expeal is NOT required. However, if you choose to communicate with a Participating Attorney through Expeal, please note the following:

  • When you contact a Participating Attorney through Expeal, he or she may provide you with an initial consultation, legal review of your forms or documents, or answers to your legal questions. Please note that any such interaction is intended to be a starting point for dealing with a legal matter or addressing basic legal questions and any attorney-client relationship formed during the course of that interaction is strictly between you and the Participating Attorney and expressly EXCLUDES Expeal.
  • When you contact a Participating Attorney through Expeal, he or she may ask you for some information regarding you and your legal affairs in order to properly address your questions. By using our Services, you consent to sharing such personally identifying information for the purpose securing legal advice with both the requesting attorney and with Expeal. Expeal will have access to any communications submitted through our platform for fulfilment and quality assurance purposes.
  • When you contact a Participating Attorney through Expeal, you control the both the duration and depth of the interaction. Any attorney-client relationship formed during the course of that interaction may, at your option, either
    1. end when the interaction with the Participating Attorney ends, or
    2. continue if you wish to engage the Participating Attorney for further legal services.
  • If you wish to create an attorney-client relationship with a Participating Attorney that extends beyond your use of our Services, that relationship will be on whatever terms you establish with the attorney in question. Those terms do NOT involve Expeal and, except for pre-negotiating special discounts for our members, we do not set, control or influence them. For example, the Participating Attorney may ask you to sign a formal representation agreement regarding the scope of work they will perform, the cost of their legal services, and the handling of any out of pocket expenses they may incur.
  • Participating Attorneys may be compensated by Expeal for Services performed on your behalf, however, Expeal does not receive any share of legal fees collected by any attorneys in our network. In all cases, Expeal will not influence or interfere in any way with any attorney's independent professional judgment. Participating Attorneys reserve the right to refuse to perform legal services on your behalf in their sole discretion.
  • Expeal is an information provider and does not endorse or recommend any attorney, including any of the Participating Attorneys. Expeal makes no representation or warranty as to the qualifications or competency of any Participating Attorney or as to the accuracy or completeness of any Participating Attorney's work.

Participating Attorneys are third-party independent contractors solely responsible for the advice they give, the services they provide and the representations about themselves they make. You are solely responsible for assessing the quality, integrity, suitability and trustworthiness of all persons with whom you communicate regarding your legal needs.

7. Expeal Paid Version

Expeal partners with other companies to fulfill Expeal Paid Version related Services. You understand and agree that Expeal will share certain personally identifiable information for you with the applicable third-party provider.

While not all states require a licensed attorney work on your case, Expeal does. Any Expeal Paid Version will be worked on and supervised by an individual with an active law license on file with their State Bar Association ("Third-Party Provider"). By purchased Expeal Paid Version Services from Expeal, you authorize Expeal and/or its Third-Party Provider to receive service of process, including any notices of legal proceedings, other legal notices, or official government communication, and any items covered by the respective statute, rule, or regulation on your behalf. You further authorize your Third-Party Provider to scan, upload and transmit any such communications received on your behalf to your email address and into your account. When appropriate, Expeal and/or its Third-Party Provider may also forward physical mail received on your behalf to the business address we have on record. To update your address, please contact us at (844) 839-7325 or support [at] expeal.com. The Expeal Paid Version is intended for users addressing their own criminal record. Communications related to Expeal filings will be directed towards the address of the individual we have on file.

In the event that Expeal does not receive full payment, Expeal reserves the right to terminate your order and cancel the relationship with our Third-Party Provider in relation to that order. You agree to bear any risk and under no circumstances will Expeal be liable or responsible for any damage or inconvenience caused or alleged to be caused by termination.

You understand that the technical processing and transmission of the Service, including your content, may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. You agree that Expeal has no responsibility or liability for deleting or failing to store any content maintained or uploaded by the Services.

  • Use in connection with any legal matter that directly or indirectly involves any Participating Attorney other than as your counsel;
  • Use in connection with any legal matter that directly or indirectly involves Expeal or any of its affiliates, directors, agents, employees, or other Expeal service providers; or
  • Use in connection with any legal matter in which your Program Sponsor has an adverse interest, or in which any director, officer, agent or employee thereof has an adverse interest. For the purposes of this provision, "Program Sponsor" means any company, organization or affiliation that purchases or offers on behalf of its members or employees, a Expeal legal plan through wholesale channels, retail channels or otherwise. Please see your Program Sponsor for additional restrictions.

You may not hack, "scrape" or "crawl" Expeal.com whether directly or through intermediaries such as spiders, robots, crawlers, scrapers, framing, iframes or RSS feeds, or otherwise access or attempt to access any information Expeal has not intentionally made available to you on its website via purchased subscription. You agree to indemnify and hold Expeal, your Program Sponsor and its affiliates and their respective officers, employees, directors and agent harmless from any and all losses, damages, expenses, including reasonable attorneys' fees, rights, claims, actions of any kind and injury (including death) arising out of any third party claims relating to your use of the Service, your violation of these Terms or your violation of any rights of another.

20. Dispute Resolution By Binding Arbitration and Class Action Waiver


Most customer concerns can be resolved quickly and to the customer's satisfaction by calling our Customer Service Department at (844) 839-7325. You can also email us at customerservice [at] expeal.com.

However, if Expeal is not able to resolve a dispute with you after attempting to do so informally, then as a condition to your use of the Services we mutually agree to resolve such dispute through binding arbitration under the auspices of JAMS Alternative Dispute Resolution ("JAMS"). JAMS will administer any such arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. The arbitration will be held in the United States county where you live or work, Miami, Florida, or any other location as to which we may then mutually agree. A party seeking arbitration must first send to the other, by certified mail, a written notice of dispute.

Any notice to Expeal should be addressed to Expeal, Inc., Attn: Legal Department, 950 North Collier Blvd, Suite 101, Marco Island, Florida 34145. Any notice to you shall be sent to your address as set forth in Expeal's records of account or such other legal address as Expeal is able to identify.

You may only resolve disputes with us or Participating Attorneys on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.

Notwithstanding our agreement to arbitrate our disputes as provided above, the following exceptions will apply to the resolution of disputes between us:

  • Either you or Expeal may assert claims, if they qualify, in small claims court in Naples, Collier County, Florida or in any United States county where you live or work without first engaging in arbitration or the informal dispute-resolution process described above.
  • Expeal may bring a lawsuit against you in any court of competent jurisdiction solely for injunctive relief to stop any unauthorized use or abuse of the Services without first engaging in arbitration or the informal dispute-resolution process described above.
  • Expeal may bring a lawsuit against you in any court of competent jurisdiction solely for injunctive relief to stop any intellectual property infringement without first engaging in arbitration or the informal dispute-resolution process described above.
  • In the event that the agreement to arbitrate provided herein is found to be inapplicable or unenforceable for any reason, then as a condition to your use of the Services we agree that any resulting judicial proceedings will be brought in the state courts of Naples, Collier County, Florida or the federal courts of Miami, Miami-Dade County, Florida, and by your use of the Services you expressly consent to venue and personal jurisdiction of the courts therein.

Expeal may, in the future, make changes to these provisions regarding dispute resolution and arbitration by providing notice in accordance with the section of these Terms entitled "Modifications" below. You may reject any changes made during your Membership by sending us written notice.
